Understanding The Labor Law After The Enactment of Omnibus Law

JAKARTA. The issuance of Law Number 11 of 2021 concerning Job Creation which was compiled with the omnibus law mechanism, amended a number of provisions in the field of employment.

Some of the provisions that have been subject to these changes include those related to the regulation of foreign workers, Temporary Appointment Work Agreement (PKWT), outsourcing, rest periods, and termination of employment (PHK).

With the change in the provisions, the government then issued several derivative rules, one of which is Government Regulation (PP) Number 35 of 2021 which regulates the PKWT.

In this regard, the partner of MUC Attorney at Law Kiki Amaruly reminded every company to properly understand the impact of these changes on their employment policies.

Especially regarding the implementation of PKWT and the use of workers with an outsourcing system which often triggers disputes between workers and employers.

"It is a challenge for the company to carry out this provision but it does not affect the financial condition of the company," she said.

She delivered the issue in a business law webinar entitled "Labor Law After the Enactment of Omnibus Law and Government Regulation Number 35 of 2021" organized by MUC Consulting in collaboration with the UOB Transaction Banking Experience Center (TBEX).

Meanwhile, according to UOB Senior Vice President Tri Febriantono Saputra, this webinar is very important because the material presented is closely related to business activities, such as how to calculate severance pay, so as not to trigger disputes.

Previously, UOB and MUC Consulting regularly held webinars with various themes, especially in the taxation sector.
