Supreme Court Revokes JKN Regulation, The Increase of BJPS Contribution is Cancelled

JAKARTA. Supreme Court canceled the Presidential Regulation (Perpres) Number 75 of 2019 regarding Health Insurance which is the basis for a 100% increase in the Health Care and Social Security Agency (BPJS Kesehatan) contributions for non-wage participants. The cancellation decision is a follow-up to the material test suit filed by the Indonesian Dialysis Patient Community (Komunitas Pasien Cuci Darah /KPCDI).

Responding to the Supreme Court's decision, Minister of Finance Sri Mulyani Indrawati assessed that the decision could affect the sustainability of the National Health Insurance (Jaminan Kesehatan Nasional/JKN) program under the auspices of the BPJS. "Of course we see the decision that the Presidential Regulation regarding BPJS will affect all the people of Indonesia. The decision to cancel just one article affects the overall sustainability of BPJS health," said Sri Mulyani at the DGT Building, Wednesday (10/3).

The Former Managing Director of the World Bank continued, the BPJS Health Regulation was made by considering all aspects, especially aspect of JKN sustainability. In addition, the Presidential Regulation also takes into account sides of justice for 96.8 million poor people that are borne by the state, people who can afford to pay for self-help, and also include the private sector.

"Everything is calculated so that JKN can run because there are funds that come from the state budget, regional budget, private budget, people who can afford to pay and the people we cannot afford to pay in full," she continued.

Sri Mulyani also stressed, the community must be prepared with significant implications for the JKN program related to the Supreme Court's decision. She also asked BPJS Health to be transparent in carrying out the JKN program.

"We ask BPJS to be transparent, including how much operating costs and how much salary, and the deficit of the budget. We summarize it so that people know this is a mutual problem, not just one institution. This is done by the government to build a healthy and fair JKN ecosystem, sustained," she added.

In Presidential Regulation Number 75 of 2019 concerning BPJS Health, which was canceled by the Supreme Court, contributions for non-wage participants (PBPU) and participants were divided into three clusters which took effect on January 1, 2020. With the issuance of the Supreme Court decision, the BPJS Health contributions are returned according to the old rules (Perpres 82/2018) (see the table).
